It is usual for the personal representative/executor to engage a solicitor to advise and assist him or her in the administration of the estate. Under s. 54, Trusts Act, the personal representative is entitled to be allowed and paid all charges and expenses which he or she may incur in this regard. The solicitor’s costs are regarded as testamentary expenses which are paid in priority to all other debts, including debts incurred by the deceased.

The assets of the estate are liable for the payment of these costs in accordance with the order of application of assets set out in s. 59, Succession Act. The only circumstances in which such expenses would not be allowed to the personal representative would be where they are unreasonable or arise as a result of his or her default, neglect of duty or misconduct.
